Participant Waiver, Release of Liability & Assumption of Risk

Important Notice: This document affects your legal rights. Please read it carefully before signing.

This Camelback Mountain hike is an independently organized, voluntary recreational activity arranged by individual team members. It is not a company event.

Participation is completely optional. It is not a required work activity and is not a condition of employment, compensation, advancement, team standing, or continued relationship with Nueva.

This hike is not sponsored, organized, operated, supervised, endorsed, funded, approved, or conducted by Nueva or any of its affiliated companies, owners, officers, directors, employees, agents, representatives, insurers, successors, or assigns (“Released Parties”).

No Nueva company representative is acting in an official company capacity in connection with this hike. Any person who shares information, coordinates timing, or participates in the hike is doing so personally and voluntarily, not on behalf of Nueva.

1. Voluntary Participation

I understand that my participation in the Camelback Mountain hike is entirely voluntary. I am choosing to participate of my own free will. I understand that I may decline to participate, stop participating, take breaks, turn around, or leave the activity at any time.

2. Independent, Non-Company Activity

I understand and agree that this hike is a personal, voluntary activity organized by individual participants, not by Nueva.

I understand that Nueva is not providing guides, supervisors, medical personnel, transportation, equipment, insurance coverage, or safety oversight for this hike.

I understand that any communications about this hike are for informational convenience only and do not make the hike a Nueva-sponsored or Nueva-supervised activity.

3. Assumption of Risk

I understand that hiking Camelback Mountain involves known and unknown risks, including but not limited to:

  • Heat exhaustion, dehydration, sunburn, heat stroke, or other heat-related illness
  • Slips, trips, falls, cuts, bruises, sprains, fractures, or other injuries
  • Steep terrain, loose rocks, uneven surfaces, exposed areas, and strenuous climbs
  • Overexertion, fatigue, dizziness, fainting, or shortness of breath
  • Encounters with wildlife, insects, plants, or environmental hazards
  • Limited access to immediate medical care or emergency services
  • Weather changes, trail closures, or other conditions outside anyone’s control
  • Injury, illness, property damage, or death

I understand that Camelback Mountain trails may be physically demanding and may require good judgment, personal responsibility, and appropriate preparation. I voluntarily assume all risks connected with my participation.

4. Health and Fitness Representation

I represent that I am physically capable of participating in this hike. I understand that it is my responsibility to evaluate my own health, fitness level, hydration needs, medical conditions, medications, and physical limitations before participating.

I agree not to participate if I am injured, ill, overheated, dehydrated, impaired, or otherwise unable to safely complete the activity. I understand that I am responsible for turning around or stopping if I feel unsafe, uncomfortable, exhausted, overheated, or unwell.

5. No Medical Advice or Supervision

I understand that no one involved in coordinating this hike is providing medical advice, professional guiding services, emergency medical services, or safety supervision. I am responsible for my own decisions, pace, hydration, equipment, and personal safety.

In the event of an emergency, I authorize reasonable efforts to obtain emergency medical care for me. I understand that I am responsible for any costs related to medical care, rescue, transportation, or emergency response.

6. Release of Liability

To the fullest extent permitted by law, I release and discharge Nueva and its affiliated companies, owners, officers, directors, employees, agents, representatives, insurers, successors, and assigns from any and all claims, demands, causes of action, damages, losses, costs, or expenses arising out of or related to my participation in the hike, including claims involving personal injury, illness, death, property damage, or other loss.

This release includes claims arising from ordinary negligence, to the extent permitted by applicable law. This release does not apply to claims that cannot legally be released under applicable law.

7. Indemnification

I agree to indemnify, defend, and hold harmless Nueva and its affiliated companies, owners, officers, directors, employees, agents, representatives, insurers, successors, and assigns from any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising out of or related to my participation in the hike, my conduct, my failure to follow safety instructions, or any claim brought by or on behalf of me or my representatives, to the fullest extent permitted by law.

8. Personal Property

I understand that I am responsible for my own belongings, including my phone, wallet, keys, bags, sunglasses, water bottles, and other personal items. Nueva and the Released Parties are not responsible for lost, stolen, or damaged property.

9. Safety Acknowledgment

I understand and agree that:

  • This is not a race.
  • I must bring sufficient water.
  • I should wear appropriate hiking or athletic shoes.
  • I should use sunscreen, sun protection, and weather-appropriate clothing.
  • I should not bring alcohol, heavy bags, unnecessary valuables, or anything that must be carried by hand.
  • I should use common sense and turn around if needed.

10. What to Bring

  • Good athletic or hiking shoes with solid grip; no sandals or flip-flops.
  • Plenty of water. Bring more than you think you will need.
  • Lightweight, breathable clothing suitable for heat and sweat.
  • Hat or visor for sun protection.
  • Sunscreen applied before the hike, with extra available if needed.
  • Sunglasses, preferably secure-fitting.
  • Small backpack to keep your hands free.
  • Electrolytes and a small snack for hydration and energy.
  • Fully charged phone for communication and emergencies. Do not depend on your phone for safety or navigation.
  • Common sense. Leave the ego at the hotel.

11. What Not to Bring

Do not bring heavy bags, unnecessary valuables, alcohol, flip-flops, sandals, or anything you have to carry in your hands.

12. Acknowledgment and Signature

By signing below, I confirm that I have read this waiver, understand it, and voluntarily agree to its terms. I understand that I am giving up certain legal rights by signing this document.

This is not a race. Stay hydrated. Know your limits. Turning around is always an option.
